A seminar on explanation of amendments made to the labor legislation of the Republic of Kazakhstan
Since 21-st to 22-d of January 2016, the chief specialist of the administrative department S. Rakhmetova. and the leading specialist of the administrative department D. Isagalieva participated in the seminar on explanation of amendments made to the labor legislation of the Republic of Kazakhstan for employees of RSE "Gosexpertiza”. The seminar was held at the invitation of the Federation of trade unions of the Republic of Kazakhstan and the Branch trade Union of workers of the construction complex and housing utilities of the Republic of Kazakhstan. Workshop objectives: to introduce the changes in the labor law, in accordance with the new Labour Code of the Republic of Kazakhstan № 414 dated November 23, 2015; introduce changes in the legislation on staff records and labor relations; provide listeners with information and explanations about the legal requirements necessary actions for the implementation of mandatory requirements, the responsibility for their failure. The following issues were discussed in the seminar program: workers' representatives and their powers; the accounting for the views of workers' representatives; the condition of not competition; term employment contract, a condition of probation; documents required upon employment; the procedure for concluding, amendments to the employment contract; secondment of an employee to another entity; termination of the employment contract by mutual agreement, at the initiative of the employer by the employee; procedure for termination of an employment contract upon expiry of the contract; in connection with the transfer of an employee to another entity; due to circumstances beyond the control of the parties; failure by the employee to continue the employment relationship; due to the breach of the employment contract; pensioners of the organization; limiting the possibility of termination of the employment contract by the employer; disciplinary sanctions; work at night, weekends and holidays; guarantee workers in the performance of state and public duties; compensation for loss of work; features of regulation of the head’s of the executive body of the legal entity labor and other members of the collegial executive body of the legal entity; the order of negotiating, development and conclusion of the agreement, the content and structure of the collective agreement, procedure of consideration of individual labor dispute, the dates of application for the review of individual labor disputes, the conciliation Commission, labor arbitration. Enlik N. Nurgalieva, doctor of Legal Sciences, Professor, participated in the development of the Labour code of the Republic of Kazakhstan, acted as one of the lecturers. The participants received certificates after the seminar.
